Considering that
• Entrepreneurship in question can contribute to local economic growth and higher employment levels in the Region;
• It is necessary establish favorable environmental conditions, including through the provision of tools to strengthen the conditions of legality and homeland security, so this initiative is not to be negatively affected and hampered by attempts by organized crime, adversely affecting the procurement phase, work on construction sites, on the market work and in any other action which would affect the normal process of economic and productive
• It highlights the need to minimize the risk of criminal infiltration and possible forms of coverage of investments made through the use of money from sources illegal
• It is appropriate to provide adequate controls such as effective means of deterrence of unlawful conduct.
Article 1 1. The company ... ... .... ... Undertakes to inform the Prefecture ... ... .. ... .. information concerning the work on creation of the production plant.
2. By way of example, the company is committed to provide the following information:
a) Any additional agreements are signed with the government and / or bodies concerned.
b) The list of companies participating in the implementation of the initiative (contractors, suppliers, companies consultancy, etc. ..).
c) An indication of any subcontractors, owners of derivative contracts and agreements, however denominated.
d) The number and names of the assumptions.
3. In particular, with reference to the letters b, c, d, paragraph 2, the company ... .... Will not entertain relations of any kind, with subjects, companies, businesses related to organized crime and / or environments criminals.
4. The company ... ... .... Undertakes to give prior notice to the Prefecture of ... ... any possible sale or takeover, either directly or indirectly, by third parties in its bargaining position.

Article 2 1. The company ... ... ... before the conclusion of contracts, is committed to: • acquire information
"mafia" within the meaning of art. 10 of DPR 06/03/1998, n. 252 and, if found to be borne by the contractor on an individual, association, consortium or cooperative, or elements of mafia infiltration attempts, there will be no award of work and / or supplies
• "in addition to cases in which operation of law is provided for the dissolution of the agreement to provide work and / or supplies at any time, the contract upon the occurrence of the conditions laid down by art. 11 paragraph 3 of the DPR 03.06.1998, n. 252.
2. The commitments referred to in this article must be made by suppliers of work and / or supplies
also in any sub-contracts, if they are needed.
Article 3
The Prefecture can be transmitted to law enforcement communications received, to make the necessary checks on the existence of suitable conditions that allow to exclude links with the criminal and mafia in respect of those who for various reasons establish contractual relationships with the company for the construction of the work in question.
Article 4
The Regional Labour Inspectorate, which must be immediately communicated to the beginning of the work, owns the coordination of control of shipbuilding activities through periodic inspection access to be performed by qualified representatives of the Inspectorate Department of Labour, the ASL, the locations of INAIL and INPS.

Article 6
1. In order to facilitate the timely implementation of this Protocol Lawfulness for alternative energy, the company ... .. ... and / or its subcontractors shall insert in their contract documents an express reference to the reporting requirements of this Protocol provided for dependents of companies and / or individuals foster and / or contractors and also provide the contractual obligation to the undertakings entrusted with the work, supplies and / or services in general, to immediately notify all data related to cases covered by this Protocol.
2. In case of violation of the commitments under this Protocol, and specifically those referred to in Articles 1 and 2, the Company hereby to accept the following sanctions may be applied depending on the seriousness and / or the number of violations of which was to be:
a) immediate and automatic resolution of the contracts, provided that the termination of the limited time to time the figure of the worker or subcontractor and / or contractor or the entire report in accordance with the type and extent of the breach of the notification referred to in this Protocol.
b) Termination of all those administrative actions in any way related to entrepreneurial activity.
3. The company is committed to compliance with the rules and regulations on safety and hygiene work, employment, contractual protection and trade union workers and to transmit, in substance, any findings made by the authorities.
4. The company also undertakes to subscribe to the companies involved in the implementation of this initiative, a special termination clause, whereby the respective ratios of any nature shall be considered automatically resolved in the case of violation of reporting requirements under this Protocol, with express waiver of claims for damages against the parties to this Protocol of legality.
5. The company and Alderman productive activities require the Prefecture, the
signing of this MOU Lawfulness for alternative energy as a means to guarantee the transparency of procedures, with particular reference to the characteristic activities and supplies, necessary for the implementation of the initiative, as well as of the start-up of production, ensuring full cooperation for effective action against any interference by the mafia.
